I have had my children all their lives. They have lived with me. Their dad has been in and out of their lives some times being involved for a year or so then disappearing for 3 months or so. We both moved from Indiana to Georgia 6 years ago. Recently (about a year ago) he decided to move to Texas while I stayed in Texas. On June of 2009 we agreed that the kids (2 of o ur 4)would visit him for the summer due to me having a major surgery (the other 2 couldn't go because they had to attend summer school).After about 2 months of being out there the kids started calling home saying they wanted to stay with their dad and try it out for a year. Me and their father agreed that we would try it out but if they didn’t like it they would return home immediately. The kids came back to my home in August once school dismissed. Once the kids started informing me of the circumstances there I made a decision for the kids to stay at home. Their dad told me he was taking them out to breakfast and then took them back to Texas to file for custody. The judge awarded him custody and that I pay child support even though I have his other 2 children. The kids sit at home all day long by their self because he’s a truck driver. They recently got into trouble because they were giving their phone number to strangers all over the world. They live in a one bedroom apartment and overall no supervision. I filed for a De Novo which I go back to court on the 25th of this month in Texas. I can’t afford representation so I’ve been doing this solo. I’m trying to get advise on what I should bring to court to show that this judges decision was not for the best interest of the kids. Plus splitting the siblings like this has caused an emotional strain on all the kids. The kids have never lived with their father until this situation. I’m lost, confused, and I feel justice was not served. Any suggestions? What can I do if anything? Other lawyers in this state has advised me that the new judge will chew me up and spit me out.
