    Dear Rajan,

    Questions:

    1. Are you a RN in U.S?
    2. Have you applied for any type(s) of Nursing license in
    U.S?
    3. Are you a citizen of Canada or Mexico?
    4. Did you obtained your degrees outside of Canada or Mexico?

    Before, I attempt to answer the questions above I would like
    to pointing out that H-1B visa may obtain from Sponsorship.
    Meaning that one of the Health facility in U.S. is willing
    to sponsor you for H-IB visa. It is difficult for individual
    to apply for H-1B visa directly, without sponsorship.

    1.If the answer to Question one and two above is yes and
    your degrees were from U.S., you don’t need a BS in nursing
    for applying for H-IB visa (You need to see an experience
    immigration lawyer for your options and legal remedies).
    However, if you have maintained an active license with no
    disciplinary sanctions for at least 5 years immediately
    preceding the application license to any other States
    license (check with that State). An application can be
    requested from that State that you planned to work (This is
    important for processing your visa if you still want to
    apply, also you can use it for future job application).

    2.If you are a citizen of Canada or Mexico, the US
    immigration law requires foreign nurses and other healthcare
    professionals to complete a screening program prior to
    receiving an occupational visa.

    The Commission on Graduates of Foreign Nursing Schools
    (CGFNS) was named as an organization qualified to offer this
    federal screening program. A new division, the International
    Commission on Healthcare Professions (ICHP) was created to
    administer the Visa Screen. Screening includes an assessment
    of the nurse’s education, demonstrated by earning a CGFNS
    certificate or passing the NCLEX, to ensure his/her
    education is comparable to a US graduate. In addition, it
    includes licensure validation and English language
    proficiency, if applicable. After successful screening, the
    nurse is issued a Visa Screen Certificate which can be
    presented to a border port of entry or embassy.

    3.If you received your degree from Foreign Nursing School
    outside of Canada or Mexico you need to take the CGFNS
    (Commission on Graduates of Foreign Nursing Schools) test
    and the NCLEX test to obtain your nursing license. They also
    need a Visa Screen Certificate, as required by US
    Immigration Law. It can take several months to obtain this
    certificate. If you have and you don't need to do so.
