Dear DJ, The time frame varies, mostly depending upon if you are a citizen, and who you are filing for, and which country are you from. Spouses of US citizens will usually get their green card in 6-12 months or less, while spouses of permanent residents may have to wait years to receive the green card. The green card holder can file an I-130 for you, but the wait for a visa number on those is very long. Employment authorization can only be applied for along with I-485 in this case, not with I-130 alone or while the I-130 is pending by itself. You can’t file the I-485 at the same time. There is no basis for the adjudication of the I-485 for a spouse of a permanent resident until the I-130 has been approved without the I-485 pending, they are not eligible to file the I-765 for work authorization. However, a U.S. Citizen can concurrently file the I-130 and I-485 because there is a visa immediately available to their spouses. Double check with your Attorney and keep working with him/her.
