Post: nul prosecute of citation and green card application

please advise What are the consequences for the application of a green card if the case involves a nul prosecute and expungement of records (citation)for an unattended child (pass off to neighbor baby sitter botched). The wife ( K-3 status - beneficiary of the application) went to the interview with ins officials in Baltimore. The case was explained (in the application for the green card). The wife admitted to the incident, forwarded all relative documents including expungement records. Child protective services conducted due diligence and found "no evidence of child neglect." During the interview with the INS they asked the wife to volunteer to make a sworn statement. In the statement the wife said she was not arrested and never commited any other crime and so forth. Though she mistated that she went to the police station when in fact she went to child protective services (CPS) to pick up the child. The citation was issued at CPS. If the case was to be prosecuted and if found guilty a possible maximum penalty of thirty days existed. The INS representative said "she thought there would be no problem." Is everything ok ? If there is a problem what procedures can be pursued to grant a green card.
