    Post: Change of Marital Status

Posted by Victor Cabrejos on 10/29/08

    Hi,

I have a question regarding the marital status of my father.

My Father became a US citizen on July of this year. And He
just went to my country to marry my mother so he can bring
    her to the US.

The problem is that when my father entered the US as a
permanent resident in 2001, he applied with a marital status
of 'Single' when in reality He was married in my country
(married to another woman)..... a couple of years ago he
divorced this person because they never lived together....so
his status in my country became 'Divorced'. But in the US
all of these years he was still 'Single'.

Now He has to fill the application to bring my mother to the
US and He is worried because in one part of the application
it requests him to describe if he was divorced, send a proof
of that divorce and list the years of him married. He is
worried that if he fills that information and sends the
requested divorce documents with the application, instead of
bringing my mother to the US He gets punished for having
been married and then divorced all of these years in my
country, and having status of 'Single' here in the US.

He is honest and wants to prove that he is divorced and now
married to my mother, but is afraid of the punishment he
might get when the application is sent.

Could you help me with this issue?

    Regards,

    Victor
