A patent examiner is employed by the USPTO and needs a minimum of a BS in certain fields. A patent agent needs a BS in a certain field (or a minimum number of credits in a technical field) and must either pass the USPTO exam or work as a patent examiner for a number of years. A patent lawyer must have the same requirements as a patent agent, plus have a license to practice law. One most frequently obtains a license to practice law by going to law school, then passing a bar exam. Some attorneys "read the law" under an attorney a la Abe Lincoln.
