Post: Can you sue with no copyright registration - just a filing?

Hi - I am being sued by a music producer who worked for me 3 years ago. He recently filed for copyright for just 9 of the 10 songs he says he authored (clearly just an oversight) - then the same day filed a lawsuit in the 11th Dist Court of FL alleging copyright infringement. In the complaint, he mentions the evidence of his "certificate of registration", which he references as the SR Form he filed that same day. I may not be a lawyer...but it seems to be common sense that this is a misstatement, as a filing w/ the copyright office is a far cry from an actual certificate of registration. Those things can take 2 or 3 years to receive. Regardless of whether his initial claim has validity, wasn't the court in error to have let him file with no actual registration - particuarly in light of the fact that his lawsuit points to this nonexistent registration as the basis for filing?
