Ask your attorney how your Circuit appeals court interprets 17 usc 411 (a). 411(a) requires "registration" in order for the Federal Courts to have jurisdiction. If "registration" has not occurred, you might be able to dismiss the case for lack of federal jurisdiction. Some circuits define "registration" to require either i) a certificate of registration or ii) a refusal to register. Other circuits define "registration" to only require proof that the application for copyright was actually mailed to and/or received by the copyright office. It depends on how your circuit appeals court (or district court) has said on the issue. This is not legal advice. Just a tip.
