    Post: MIC, incorrect BAC level

Posted by Patrick, Patrick_Callan@baylor.edu, on 2/02/04

I was in a parking lot at around 2:30 in the morning when
a cop rolled up. He called me over to his car and asked me
if i had been drinking. I said no and then he stepped out
of his car. he took out a pen and started to do an eye
test on me. He asked me again if I had been drinking and
the second time i said yes. I didnt tell him this but I
had started drinking around 7:30 and stopped around 12. I
didnt have that much, maybe 10 or so. I told him I had a
few beers. He took a breathalizer out and told me to take
it. I told him i didnt want to and then he said he was
going to take me to jail. I asked why and he would not
respond. He said take the test and I asked what would
happen if it showed up that I had been drkinging. He told
me that if i didnt stop asking questions that he would put
me in the car and take me to jail. So fear of being thrown
in jail i took the test. I kept on trying to look at the
breathalizer and he kept on backing up, I looked over one
last time and he said he would tell me what it said in a
minute and that i needed to stop. He made me walk to the
front of the car and stand and wait. He never did show me
the breathalizer and he just started writing out the
ticket. I soon found out that he gave me a .53% BAC which
is totally impossible for me. I am only 5'7 and 165 lbs. I
have been doing research and to have a .53 BAC I would be
close to death and already unconcious. It is obvious that
this is bogus and that it isnt true.

My question is would a judge recogonize the crazyness of
this case and dismiss it? Should I get a lawyer?
