I am in a very grey area here. I really cant figure it out.

Take 'Oklahoma' as an example, can I draw (as a cartoon)
my interpretation of 'Curly' sitting on an elephant 'who's
eye is as high as an elephants eye' put the
word 'Oklahoma' underneath it and sell it in Oklahoma as
perhaps a souvenir?
