Post: Copyright vs Trademark

Posted by Tattoo Gypsy on 3/07/07

    Greetings All.
30 odd years ago I created an original design of a witch
with the wording CAUTION BORN AGAIN PAGAN. Since retiring
from tattooing I have started placing some of my original
designs like that one, on t-shirts and such. Recently this
t-shirt design was yanked from the sales site I was using
because a company named Caution Brand Apparel
http://www.cautionwear.com/ says THEY own the trademark of
the word CAUTION and my work infringes upon their
trademark. That supposedly the word CAUTION on anything is
in violation of their trademark. So who's ownership
superceeds who's here? Do they have the right to stop me
from printing my own design, to which I hold the copyright
to? If not how do I proceed in protecting my interest in my
own design? Thanks for your help. Tattoo Gypsy
