    Post: Unreasonable expectations from Landlord...

    We moved into a house in December of last year. When we
    spoke with the landlord at the time, and it got close to us
    having to move, we found out that the landlord actually
    lived in the basement. Concerned about this, because we do
    have 3 boys, we asked several times and confirmed that this
    would not be a problem. He voiced slight concern, but
    really made it sound like it shouldn't be a big deal. It
    was not included in the lease agreement that we would have
    to fulfill some of the expectations that were brought up
    soon after we moved in. It wasn't more than a few weeks
    actually when the landlord started complaining about our
    kids' noise, even though he had been forewarned and knew of
    this.

    Since then, he has expected us to stop doing dishes past
    around 9 pm or 10, laundry at night is no longer allowed and
    the most recent thing has been that he's issued us a
    "letter" about the continuing noise. he has brought up the
    noise to us a few times, but our kids really are just being
    kids in the sense that they do get loud, but no more than I
    see 90% of boys in other families!! In this latest letter
    he has accused us of making what he called (and this might
    make you laugh) "routine living noises" between the hours of
    12 and 2 am. He pointed out a specific date and we know
    this is a false claim and we never do our dishes which he
    accused us of in this letter, that late at night!!
    Especially when he has been so ridiculous about it! I am
    cursious as to what we can do. Right now he is saying that
    we can start looking now for a place and reasonably, he
    won't hold our deposit, (he says, but we know what he did to
    the last tenants after we moved in -- kept some of their
    dishes AND some of their deposit!) And then adds that he
    does not see any reason he would want to extend our lease
    past this year. We've only been there 4 months and he's
    already saying he wants us out!

    He has admitted to both my wife and I, amazingly enough,
    that its actually his fault that the noise is so bad since
    he didn't put in insulation between the floors when he made
    the basement a living unit! Can we use that as a defense?
    Is it reasonable to ask us to not walk around and move
    chairs or "live" at that time of night? My wife works late
    nights (sometimes til 2 am) and I stay up so we can see each
    other everyday..

    I have the letter and am going to make copies and post to
    get as much advice as possible on this.. we need help here
    as we (especially my wife) do not enjoy uprooting our kids,
    and especially not for reasons such as this.
