Post: suspect mold in rental house

    Posted by melissa on 8/04/06

we've been renting a house for just over a year and as
soon as we moved in, we noticed an air quality problem.
we weren't sure of the cause because the house had not
been lived in for several years and wasn't cleaned very
well prior to us moving in, so we suspected it was dust -
but the basement always had a very musty smell that would
permeate the house, so we believe it is mold. we let the
owner know and he did have the air ducts cleaned. he also
said we could go ahead and arrange for the house to be
checked - essentially he put the responsibility on us to
do it. we haven't had time to investigate this and
basically we feel that this is his house, we are renting,
and not being experts we weren't sure what to do. he's
done nothing about it since we let him know about this (it
is documented) and now in the heat of summer the smell in
the house has increased dramatically, and we are feeling
the health effects as well - runny noses, headaches, itchy
eyes, fatigue, etc. we also have a 2 year old who is
breathing all of this 24 hours a day so we are very
concerned. we want to move but also want to understand
what our rights are as tenants since we've been paying a
significant amount of rent this entire time, and we've had
to do so much to make this house livable as it is we do
not want or feel it is our responsibility to take care of
this problem ourselves. is there a way to hold him
responsible in case any health issues arise that are
attributable to what we suspect is a mold problem in the
basement? what about the rent we've paid and still have
to pay until we find somewhere else to live? thanks for
    any guidance you can provide.
