Sure they can evict you for non payment of rent and breach of
    Contract or the Lease

I always say that month to month tenancy always works
wonderful for both parties, the tenants and the landlords

Try to explain the Judge what you just told us, that your
husband who is also responsible for the rent, went away,
regardless you are both on the lease, you are both responsible

You really don't want an eviction on your record

Call your husband continually and tell him to send you the
money or he is going to have to pay a lot more than he already
    owes to the landlord

Has the Landlord serve you with a 30 days or 5 days notice yet?
