    Post: Landlord Tenant Relationship

    Posted by vanessa on 8/02/07

I got into this situation, where i signed a lease with this
girl who was dating the landlord. When we were all sitting
and talking about the lease terms, and how the rent was to
be divied up monthly (half/half) I was agreeable to those
terms. I had no idea that she was in arrears with her
boyfriend (LL) and All my payments of my poriton of the
rent was always paid on time. He serves us this notice of
pay rent or quit, (FYI wasnt legally served, he left it on
my coffee table while over visiting his girlfriend, whom he
also served also) and immediately wanted to opt out of the
lease. So i had informed him that i wanted to terminate my
lease with him and Sonia (GF) and had told him that money
for 1st month's rent (Augst) was too late and would go
through to his account and i was due to vacate premises 8
\01 and would need my check for my portion of the rent. He
decides on the day of, since his GF did not come up with
the deliquent amount to take my money (1st month's rent, +
my deposit) and apply that to roommates arrears. Now he
never had disclosed in the beginning of the signing that I
WILL END UP PAYING if roommate does not come up with her
end of the money. If that was the case, i never would have
entereed in to the agreement. But it states on the lease
that both parties will be responsible forthe entire amount
monthly. Now, I know this situation is messy because of the
whole BF/GF landlord tenant thing, but what are my rights.
I know i might have to collect my money from roommate, but
i also want landlord to suffer damages for all the stress
of knowing the fact that his GF wasnt stable enough to make
her part of the rent. almost as if he wanted to stiff me.
And the fact that he took my 1st of August's rent, when i
already vacated his premises, he even went there on august
1st at 8 a.m. to change the locks to the door.
any advice would be helpful. thanks
