Re: Has LD committed the tort of Defamation or "false light?"

    I wonder if LD's posting of an email falsely attributed to Ms. Barnes
    is the tort of Defamation by liable or the Privacy tort of "false
    light."

    These two torts are similar but a separate species of tort. "False
    light" is a subcategory of a Privacy tort while Defamation is a tort
    class on its own not within the class of torts called Privacy.

    There is no doubt that a false (untrue) statement was made in the
    email. If the false statement was ABOUT Ms. Barnes it would clearly be
    Defamation. However, the false statement appears to be about a topic
    not about a person. Since the email was falsely alleged to be from
    Ms. Barnes, I think we are looking at a "false light" tort.

    Anyone have an opinion on whether LD has committed the tort of
    defamation or the tort of "false light?"
