Post: GA: Bankruptcy help

Posted by Concerned/confused on 1/11/10

Quick question, we are currently helping mother inlaw with
expenses as she has fallen on hard times. Can not do this
for much longer.. She has her own home, and is on fixed
income(social security) is failing in health and has
numerous medical expenses. She can no long keep up with
her mortage, credit card debt and expenses ... Claims she
spoke with lawyer about bankruptcy and was told she has
too much equity in the home to do this. Tried to refi home
and use equity to pay debt but they wont refi due to her
fixed income and debt ratio. Question, would this be
correct that she can not claim bankruptcy while she has a
home she is still paying mortage on? I was under the
impression your home was to be protected... any advice
appreciated, we just simply can not continue to pay for
    her and ourselves....
