Post: Flood culpability after notice to fix aged waterheater

My upstairs condo neighbor has flooded me four times. All his appliances break before he replaces them. The issue now is his ancient water heater. Is there anything I can do to make him liable if it leaks on me? Can I sue him after warning him of my concern? I fully expect it to leak before he replaces it. All the information I keep getting says he’ll only be liable for my insurance deductible. This can’t be right.
