Post: Petitioning to relinquish fathers parental rights... How?

Posted by Ashley C. on 6/16/13

I live in Montana. We were never married. There is no
parenting plan or a court order for child support. The
child is almost one, and the father has had very little
time with her.. About 3 months worth.. He and I split, and
he hasn't had any time with her nor does he want to.. He
and I both want him to relinquish his rights voluntarily..
I am backed financially through myself and my family.. And
I'm receiving gov assistance to get my child medically
insured. Now, the father is in the army and will be gone
most of the time for that, he also has to file bancruptcy
for a 30k loan from 7 years ago.. I hope this info helps...
What I want to know is, do I have a reasonable case where
the judge will honor the petition to voluntarily terminate
parental rights of the natural father? Or should I wait til
the father doesn't have anything to do with us for over a
year and file for abandonment? Will the courts try to make
him fulfill his parental rights then or will he get in any
sort of trouble for abandoning his child? I just want this
to be simple. I've thought it through and I want sole
custody without blaming anyone for being abusive or
whatever.. That's not the case! I just want him to be free
from her and I, and so does he.. Any help out there?! Thank
    you!!!
