Below is a letter that I sent to the governer of NY STATE.
I really need help so anyone's response on this message
board would be appriciated

HISTORY:
My case is presently in the workers comp system. My date of
injury was on 05/13/2000 nearly a year and a half ago. My
injury was sustained as a member of the culinary department
at the Waldof=Astoria while caring an ice sculpture with
someone else who slipped resulting in a 300 lbs object
falling on me.

My workers Comp Case:
I have taken MRI's and EMG's since my injury date
(05/13/2000) which all show raw medical evidence of my
injuries which are:

724.9 Cervical derangement
724.9 Dorsal lumbar derangement
718.9 Left shoulder derangement
Discs bulge L4-5, L5-SI

The above condition has me declared at this point as
Permanent Partial Disability leaving me Totally disabled.

Situation:
Not once during my proceedings has the insurance company
approved any type of neck or back brace. I see their
doctors and they say there is nothing wrong with me despite
my raw medical evidence. And I have not received any
benefit payments since May 1st,2001. I went back to court
with all my medical evidence on Oct 30th,2001 and despite
the Judges warning to them of having significant findings
on behalf of my medical situation being true and not to
waste his time in a trail situation subjected to a fine.
They appealed all the medical findings to go to trial which
is not scheduled to 02/04/2002.

This in effect puts me in a situation of no payments made
to me for a period of 10months and I have a family of 4
children and no means to provide for them let alone keep up
with my bills or rent. My wife is one year out of college
and we are living off her $14.50 an hour job, which leaves
800 dollars ever two weeks after taxes. Our rent alone is
$1500 a month. We do not qualify for Social Services
because she grosses $150.00 too much.

I worked for 10 years as a professional chef and was at
the top of my industry having worked for some of the top
hotel companies in the world (Ritz Carlton, St Regis, and
the Waldorf) I managed to have saved 25,000 dollars at the
point of my injury which is now gone and I have 60 dollars
in the bank and no means. I am left with $26,000 in student
loans for a degree in the culinary arts that I can never
use again. We are hard working people with no where to
turn , and cannot even wage any type of campaign against
the Waldorf since I was an employee. This will forever
change my life, instead of making the 80,000 dollars a year
plus at this point … I now am in poverty but not enough to
receive any type of help from anyone .This case has not
been about my health what so ever. More so a big company
trying to get out of taking any responsibility for an
accident that happened in the line of duty.

I would like to speak to someone from your office .because
something needs to be done about this ..as I am sure I am
not the only one in this situation …to where companies are
taking advantage of the laws your administration passed!
