If you do that, it will blow up in your face. If you cite a new injury, it is insurance fraud. It is true, that you will not recieve workmans comp from the new job being that the injury did not occur there. The appeal is fine, which can result in you getting back pay for lost wages at your previous job-but as far as claiming a new injury, i cant say i am surprised that a lawyer would tell you to do that. However, think about it- when you go to court again, they are going to see your medical records and documentation regarding your last case. Also in order for it to be a new injury, your docter would have had to say that you were healed of the previous one. Otherwise, it will look exactly as it is-that you were injured, got fired, needed a job, and took your old injury to a new employer and decided to try to get workmans comp from them. I would really suggest not doing this, because it is not your lawyer that would get in trouble for insurance fraud, you would...By the way, did you tkae FMLA at your previous job while you were out? If so, they coud not fire you......... Good luck
