Post: this seems illegal

I injured my back at my previous job, which I was on workmans comp. The judge found against me, but my attorney is appealing. I am having the same problems with my back at my new job (I HAD TO GET A NEW JOB, BECAUSE MY OLD JOB INFORMED ME THEY DID NOT HAVE A POSITION FOR ME WITH MY INJURIES, SO THEY TERMINATED ME). My attorney told me I have to pretend this is a new injury that happened at my present job in order to receive any compensation. This did not happen at my present job, it is a continuation from the previous job, and I have never signed anything saying that the previous job was not at fault I would not feel right blaming this on my present employer. What do I do now?
