Post: Workmans comp, personal injury

Louisiana Legislature has established that an injured person has three years from the date of injury to file a workmans comp suit for damages. My mother had a job realted injury in 1997. She fell due to a piece of heavy machinery pushing a carpet roll that she was standing on, over in a warehouse. She injured her right shoulder, which has after this amount of time become a serious injury that has required two surgeries, and left her with only 40% of the use of her arm. She is about to have to undergo further surgery, and has passed the three year time limit to file the suit. I believe a quote that I once heard that stated "the only thing that never changes about the law is its ability to change. I am curious if there are other states that have longer time lines allowing clients to file suit, in cases like this one that have hidden damage/injuries that do not come out in its' totallity for a few yearsfollowing the incident. I believe there is a case to be made, and a precedence to be set. Anyone out there have anything to say???????????????????
