Post: HIPPA Violation

Good Afternoon, I'm considering legal action, and wondering if someone can tell me whether or not I have a case. I have been undergoing treatment for a torn disc in my back, and a herniated disc that's pressing on the S1 nerve. I contact my orthopedist's office on Monday, after a visit with the Orthopedist on Friday. I had a question about the medication I was taking, and the triage nurse went on a witch hunt. She called my pharmacy and asked my pharmacist what medications I was taking, and who had prescribed them. The pharmacist, gave her the information, including names of doctors, dates when medications were supplied, and the names and dosage of each medication. The relationship I have with my physician is now fractured, and I'm concerned that this nurse has put something in my medical file that was solely based on assumptions. From my understanding, HIPPA is set up to provide Iron Clad protection of patient's medical information. I know you have to sign a release even to send information from one doctor to the next. This was done without my consent, written, verbal or implied. Do I have a case for a malpractice suit for a HIPPA violation? Who is at fault, the dr's office, or the pharmacist? Please help. Thank you.
