"BUYERS BEWARE! I like that. I bought a home in 2002. 6 weeks
later we had to move out because we had defects in and under the
home. A co-worker suggested I look at my disclosure to see if I
missed anything, I couldn't find a disclosure so i called the
realestate brokeer and asked for a copy. By this time a mold
test had been done and he told me it was a legal issue. I had
to retain an attorney. We met and he said he would give me what
I wanted but if he went down someone was going down with him and
he just didn't believe we could figure it out. You can imagine
what i thought. 'You can't say that, that's fraud.' Then the
Lender signed off on the inspection report that clearly states
that it is to be signed by the seller's or the sellers listing
agent. The Appraisor appraised the house before he inspected
the crawl space, which was exactly the amount need to obtain a
loan. The sellers said they took up the linoleum because the
dog chewed it up. And they knew, the smell was strong and i did
ask what it was. The realtor said it was the old part of the
house. My insurance wouldn't pay saying it was a pre-existing
condition, which the structural engineer said it had been there
for months or maybe even years. So I am suing the sellers and
the realtor for fraud and negligence, the appraiser, lender, and
inspector for negligence. My attorney said i had a case but he
bailed out, just before trial. strike that. withdrew. I am
today without an attorney but am still fighting. I right my own
response to interrogatories, answers to motions for summary
judgment and brief in motions. The attorney for the realtor,(I
just found out) has been appointed by the Oklahoma Legislature
to the Joint Task Force for mold and mold remediation to make
recommendation. a couple of days ago at pretrial conference, I
asked the judge to dismiss him for this cause that it was a
conflict of interest. He said i'm not going to rule on that!
And asked if there was anything else. I said yes sir there is,
I would like to ask the court to tell the attorneys to refrain
from sending me intimidating letters. and he said ma'am they
have to communicate with you since your attorney has withdrew.
I said yes your honor, but i'm a single woman and i'm not
accustomed to being demanded to do something for someone who
grieves me continuelly. Well he said he would note that. Now
is there something wrong with that or what. We go to jury trial
April 19, 2004. I hope i can retain an aggressive attorney who
knows what i'm going through and show the facts the way they
are. BUYER'S BEWARE! Isn't that a term they use in
Realestate! That's to let you know, they are just out for a
commission. And they say they stand by a Code of Ethics. I've
seen their ethics. If the inspectors don't catch it we won't
either! My 1 year old son sounded like he was gasping for air,
and a few days later his nose bled in the bed. Don't rely on
Code of Ethics, someone might die!
