RE:/ I Need Assistance To Appeal Or Motion For
Reconsideration Of Denial Of Default Judgment Because I
Received Zero Dollars On My Default Judgment (GIC 848888)
The City of San Diego allowed Defendant San Diego Police
Officer John Bailey (Badge No. 3026) to default. He has
failed to respond because he has no defense. A Default
Judgment was entered on August 31, 2005. On September 1,
2006 Judge John S. Meyers entered a zero dollar amount for
damages because as he put it “I said so.” Well I don’t
follow the “I said so rule” and I don’t want to go that
route. Especially when two weeks prior he entered
$25,000.00 on august 18, 2006 at 2:00 p.m. hearing for prove
up.
It is my understanding that a Default judgment is a binding
judgment in favor of the plaintiff when the defendant has
not responded to a summons or has failed to appear before a
court. In a civil trial involving damages, a default
judgment will enter the amount of damages plead in the
original complaint which is $1,500,000.00. COMPLAINT FOR
DAMAGES DO TO: (1) CALIFORNIA CIVIL RIGHTS VIOLATION-CAL.
CIVIL CODE SECTION 51 ET. SEQ. (2) FALSE ARREST AND
DETAINMENT IN VIOLATION OF 42 U.S.C. 1983. (3)
ASSAULT/THREAT, & INTIMIDATION IN VIOLATION OF 42 U.S.C. 1983.
The term "default" refers to a "failure to act" and the term
"judgment" means the "final disposition in a legal
proceeding." This is the reason why I need assistance to
reverse the Judgment of zero amount. I believe that the
order not to grant me the default judgment will be
overturned, because the judgment was granted without being
given due process.
ALL court documents concerning the default judgment show the
address, notification procedures, dates and names (i.e.
Proof Of Service By The Sheriff). Please help, the court
erroneously refused to entered judgment on my default, which
was entered on August 31, 2005 against a San Diego Police
Officer John Bailey, all the evidence shows liability.
The court also erred by not awarding attorney fees and by
not entering a permanent injunction.
