Post: Ethics in Referral Fees

Posted by Bruce on 5/17/10
I have a client who is a chiropractor - I do his business
work. I've gotten a few PI referrals over the years. I
recently told him I'd like more PI referrals. He said he
has been thinking of starting a PI law marketing firm, and
offered to partner with me on the marketing firm. His idea
is that the marketing firm will charge a consulting fee that
is not a percentage of amounts collected.
Question: I understand lawyers can't pay referral fees to
non-lawyers under the ethics rules (Georgia). But lots of
attorneys pay marketing fees. Where is the line drawn?
For what it's worth, I've known this guy for several years,
and have always known him to not be the sleazy chiropractr
type.
Thanks!
Bruce
