Post: Question about Texas UPL

Posted by Marty on 1/20/09

I was reading about a company that is called a "bankruptcy
petition preparer". I had once looked into offering a
similar service (along with the preparation of divorce
petitions) but some research seemed to show that preparing
legal documents (even if only a typing service) would be
considered UPL in Texas. Has this changed...or did I simply
    mis-understand in the first place?

This is what I'm referring to. It's on the State Bar of
Texas site under the Paralegal section:
Preparing legal documents for the public is also reserved
for duly licensed attorneys and to “draft” legal documents
for the general public without working under the direct
supervision of a licensed attorney is to engage in UPL.
Opening a “forms” practice that provides standard legal
forms for the general public, may also be engaging in UPL by
simply choosing or recommending a particular form.
