Last November I was hit while I was backing out of my
parking space. Before I pulled out I checked both ways,
when I saw that there was no one coming I slowly started
to back out. I looked over my right shoulder agian and
saw a car approaching pretty fast so I stopped. The right
front fender of the other car struck the right rear end of
my car taking my bumber off. When her car stopped moving
her rear end was at my rear end and my car was pushed over
to the left about two feet. The officer that arrived on
the scene said that the accident was "ultimately" my fault
because my car was in the parking space. I didn't not
have insurance at the time so the girls father filed a
lawsuit against me and won due to a neglegent laywer who
told me my court date was a month later. He claims he
didn't know I was being sued, but I faxed him all the
paperwork. I tried to reopen the case after the default
judgment was set, but it was denied. I have pictures of
the position of the cars after the accident, and if you
use common sense you can see that if someone was going the
posted 5 mph speed limit they would've; a) been able to
stop their car, or b) not done so much damage to the other
car. Please respond with any opinions or advice you may
have for me.
