Defense deposed my clients physician in personal injury
case (MVA), depo occurred two months ago and they still
have not disclosed the transcript. The testimony actually
helped my clients case and hurt the defense. Can the
defense withhold from submitting the transcript and avoid
using it in the case? I am weighing order to compel, but we
are very close to ending discovery with mediation within
months.
