Post: Employment

I have worked for company since November as a temp. I was offered a permanent position. Upon accepting position there was a background check done. Which shows an arrest in 1978 for theft. Was asked to prove the outcome of this arrest, but cant as I was never convicted. My employment is depending on this information. Is is legal to deny me employment because of this?
