Even if he has technically committed a crime, I would try to work this out without criminal prosecution. If you can't work it out between you without making it a federal case -- Maybe you shouldn't be partners. In a partnership each partner owes a fiduciary duty to the partnership. Also remember in a general partnership each partner is liable for partnership debts out of their personal assets. We could discuss how "apparent authority" of you or your partner to incur partnership debt could make you personally responsible for the debt; but just realize that you are in a relationship where your partner could do a lot worse than just open some mail. Again, if you can't trust each other it is time to dissolve the partnership.
