Post: mail tampering

I have rented my home in another state. We were expecting a package from FED EX to be delivered to us in our new home. The package was incorrectly delivered to our old home and our tenant has apparently thrown that package away. The package was extremely important to us and contained information we needed to re-structure our home loan. Tenant has admitted that she did recieve the package, I told her I would have a friend stop by and pick up the package so they could forward it to us. She told me not to bother and that she no longer had the package. Is this mail tampering? Do we have a case against our tenant?
