Jim, Like it or not, you were using the ladder wrong. It is quite difficult to adjust the height of the ladder when it is already vertical. That is just not how it works. You are in charge of your own limbs - it would probably be best if you kept them out of the way next time if you choose to use the ladder in this manner. My suggestion for all multi purpose ladders is to adjust the height of the ladder when it is in the A-Frame mode or when it is flat on the ground and then put it up against the wall. But why listen to me... I am just an bystandard not stupid enough to waste time over wasteful litigation. Be more careful.
