Update on my Lawsuit against Lowe's and Werner Ladder ....after spending several thousand dollars on legal fees, My case seems to progressing. I provided a 3 hour deposition for the werner/Lowes lawyer and have both the video and hardcopy version. I hired a scientist at a university to study the materials and design of the ladder that caused my horrific fall and the expert testified that the support braces at the bottom of the ladder were poorly designed and would buckle/fold/cause failure when there was less than 100 pounds weight on the ladder with any twisting/torque at all. The braces on the bottom of the ladder are very weak and Werner and Lowes MUST spend the money to inform the consumer that these ladders are "an accident waiting to happen". I am fortunate to still be alive. My fall was terrible and I was all alone and thought I would surely die that way. By the Grace of God, I managed to retrieve my phone and after passing out several times, was able to call 911 emergency. I was medflighted to a hospital over 45 miles away due to the closed head injury. I still have metal plates in both my wrists with several screws. Lots of pain. Cataplexy and Narcolepsy as a result of the closed head injury. Also suffer from sleep apnea and have to sleep with a cpap or will lose my driving license due to danger of having a seizure while driving. The negligence on Werner's and Lowe's part to not at least inform customers that the older ladders WILL fail due to the DESIGN FLAW is certainly criminal. It bothers me knowing that people have actually died since my accident due to the poor design of the Werner Ladders. Don't take my word for it...go to Lowes and look at the new Werner ladders. The bracing at the bottom of the ladder is HUGE. It is a much stronger design and will not allow the ladder to twist/break/fail at that location. The ladder I purchased in 1997 was over 10 years old when I bought it new at the Lowes store. I thought when I purchased it, that it was the best on the market. I never guessed that Ladders had an expiration date on them??? Werner and Lowes should INFORM the WORLD that their older ladders are DEFECTIVE, POORLY DESIGNED, AND WILL KILL YOU!!!!
