Post: broken titanium screws in neck fusion

I had neck bone fusion surgery in 1999, by 2001 I was back in complaining of headaches. Was told it was stress, recurring migraine headaches and given pain medications and learn to live with it. It is now 2012 and I am still having neck pain and headaches, Was told the same thing and also that arthritis had settled in my neck. I was persistent in getting further help. Many steps were taken to resolve the pain issue, I finally met with a neurosurgeon whom basically told me I was Doctor shopping for pain pills and to keep shopping. After seeing my anger to that remark decided to do a ct-scan. Results were that the fusion never took and the top titanium screw is fractured in two places. I am not a surgical candidate because of heart disease. Any action available against the manufacturer of the titanium screws?
