Post: Can a Notary Public be sued?

    We were in a contract for deed on a property. Everything
    was going fine until the market started going south. My
    husband lost his job. We fell a couple payments behind.
    According to the contract, the seller had the right to
    take possession if we defaulted out more than 30 days. We
    were told later that you can't really even do that on a
    contract for deed. Has to go through foreclosure
    process. Anyway, we discovered that a document we signed
    at the closing which was to be used if we defaulted was
    signed off by the notary public 13 months after we
    originally signed it. We weren't present for this. The
    property was of course switched back into the seller's
    name upon notarization and filing. We weren't present and
    we didn't even know it had occured.

    So....can we sue the notary? The law firm that employees
    the notary? They obviously were aware of what was
    happening. We are two well-educated idiots who got talked
    into this contract for deed in the first place. I just
    want to know my rights here. Also, what type of attorney
    is the best with this type of possible case? Thank you!!
