I am considering representing a client on a
misrepresentation claim involving a home purchase. The
previous homeowners knew about defects in the structure
but did not disclose those defects on the disclosure form
provided to my client and instead misrepresented the
particular item as fine. I am not very familiar with the
issue of “subrogation” but I am wondering if there is any
way to make a claim via subrogation on the previous
owner’s/seller’s homeowner’s insurance. I am only familiar
with the use of subrogation working so as to benefit an
insurance company in a claim against a third party.
