I'm in the process of suing over a similar issue. My client used a home inspector and he failed to identify/warn my client of a ton of latent defects. The seller's have split for another state so I'm going after the inspector for negligence. He has insurance (with deep pockets) so we'll at least get something to cover his losses. You could go after the seller but it could be a long battle and they may not have enough $$ to get a decent judgment executed against. Most home inspectors are required by the state they are licensed in to have erros and ommissions (malpractice) insurance.
