Post: Bankruptcy and inheritance from an auntPosted by Rebel4u on 10/31/07
I had just started the process of getting papers together
and my aunt dies in another state. I refused any interest
in the will and ask the attorney in that state to look into
it and do what ever he could do legaly to make sure I was
not intilte to any of the inheritance. While this was being
look in to I proceeded with the bankruptcy in another
state. Based on the information I received from the
attorney for my aunt estate there would be nothing that
could be done. According to him it would have tobe included
in the papers for the bankruptcy. A few weeks before going
in front of the trustee I supplied all the info to include
it in the bk (addemdum to the filing). I was informed at
that time only 40% of the money would be need to satisfy
the completion of my filing. after the meeting with the
trustee and all papers were signed (including the addemdum)
I received the check from the estate. I took to the
attorneys office and repleatly asked them to take the check
until this was settled. Do to bk I needed to replace my
car, asked again if I should do this (buy a car)with some
of the money. I ask when should I pay the money owed (this
went on for 2-3 months. Trustee did finaly notified me and
the attorneys office made a bunch of mistakes as noted by
the trustee. The trustee demanded all the money and show
cause for why this was not to be so. My attorny requested
more money to repair the mistake that they made on my
papers and to respond to there mistake. So I paid them and
30 days has gone by since I paid the additional money and
they have not done a thing. When I called in it was told to
me to make appointment with them for 2 weeks so they could
look into this and see if they can do anything at all. I
need help I have no money and I don't think this is right.
