    Question:

    I understand that the IRS does not penalize a person who
    fails to file a federal return where that person was owed
    a refund.

    As a practical matter, do State practices follow federal
    practices. i.e. If a person fails to file a state tax
    return where the filer was due a refund, does the State
    normally pursue criminal charges against that person? The
    text of NC's statute does not seem to differentiate b/t
    these two types of people who may have failed to file.
