Post: Malpractice settlement

Please advise if a malpractice settlement in California is
taxable income or not.

Also if a client owes back taxes and has a considerable
sum of money from the malpractice settlement and has no
source of income could the person qaulify for an offer in
compromise while not having to use the medical malpractice
funds.
