I have a quick question .....if a person trespasses onto
anothers land trying to avoid an imminent accident and
doent see the bushes on the property are they still
liable for trespass to chattels and conversion.... even if
they dont have the intent to damage the personal
property...normally I would argue that they are liable
however ..the intent factor except for the trespass is
missing...ergo the the intent element of each other of
these torts is not there but the trespass causes the other
damage.....where do I go on those issues????
