Post: Parent liability for negligence of minor in Georgia
Posted by Dave on 5/21/05
I'm a bankruptcy attorney in Atlanta, GA. Client is
recently divorced. Client's ex was supposed to maintain
auto insurance on their minor child, but allowed it to
lapse. Minor was in an accident, all his fault. Victim's
insurer is now suing my client and names the minor child
in the suit as well.
Is parent liable for actions of the child (at least if it
is only negligence, and not some sort of higher grade
tort)? Client plans to file bankruptcy anyway, for many
reasons in addition to this potential liability. Question
is whether minor can be held personally liable himself or
not.
Thanks
