Post: Frivolous lawsuit could tie up house

    Posted by Keith on 5/26/05

Our family trust, set up by my dad and mom owns a residence house and a rental house. My dad passed away recently and the renter called up asserting that he had a deal with my dad to buy the rental home. He never had any such deal and can produce nothing in writing, however the lawyers are telling me he can block sale of the house pending a frivolous lawsuit claiming he has an interest in the house. This suit could cost us tens of thousands to defend and tie up the house for years the lawyers tell us. He is asserting that he and my deceased dad had a deal, and that this deal was for hundreds of thousands of dollars less that the house is currently worth. This deal was supposedly made 20 months ago. It is a transparent ploy to make us sell the house to him cheap to avoid threatened litigation. This all seems to me like "abuse of the legal process" and he should be wide open to a countersuit. Does anyone have any suggestions or know anyone who can help?
