Yesterday I received a letter from "the board of
directors and/or compliance committee" where I live. They
wrote me "in reference to the removal of the two over-
sized dogs from your unit".
We have a 20lb weight limit policy for the cluster in
which I live. Both my dogs (we can have two dogs as well)
are well under the 20lb weight limit - they are miniature
American Eskimo dogs --of which I have indisputable
proof. However, they look substantially larger than most
other small breeds due to their thick, long, bright white
coat and they stand up to 15" in height. Any idiot who
researched the breed would have found that out.
First, let me state that this was the ONLY notification
I'd recieved from anyone regarding my pets! The letter
went on to say I'm either guilty of not reading my condo
regs, or I purposefully disregarded them...either way "the
Board of Directors would like your two over-sized pets
removed immediately."
They end the letter by hoping I understand and appreciate
their efforts to follow and enforce the association
documents and to always strive to make the place I live
a "great place to live".
No warning, no consideration for the truth or even
inquiry...just assumption, judgement, conviction and
sentencing . I have vet & breeder docs as to weight and
breed standards, so I have no concerns they can legally
force me to get rid of two beloved members of our family.
However, the emotional, psychological and physical (yes,
physical - I'm on Soc. Sec. disability for chronic pain
that worsens under stress)upset this whole situation has
caused me (not to mention the anger and frustration! I
thought I still lived in America??? you know, innocent
until proven guilty?.
Anyway, once I've provided proof of my dogs weight...can
they be held liable for harassment? I wouldn't consider
it had they at least inquired about the dogs first. But
instead they attack me with an untrue, mean spirited,
intimidating, bullying letter telling me I had to get rid
of the dogs immediately! No recourse...no discussion. I'm
just supposed to lie down and take it? Does this
constitute legal harassment? That's all I want to know.
