Under the circumstances you described, it is likely that the school would be vicariously liable for the actions of the teacher -- it's employee. The first step, if you want to pursue compensation for the injury to your child, is to contact a personal injury lawyer in your community asap. If this is a public school, there is likely a short deadline to file a "notice of claim" in order to perserve your rights. So consult an attorney immediately. Good luck. P.S.
