Post: Unlawul Repossession of a Vehicle
Posted by Mary on 5/15/06
I have a Honda Ridgeline which I purchased at the end of
last year. I get a little behind on the payments from time
to time - that's another story. I got very behind and in
April received a call from Honda Finance telling me they
inteded to repossess. I called them back and left a
message that I wanted to take care of the arrears right
away, but they did not call me back. The next day I called
again and someone tried to connect me to the person I'd
left the message for the night before, and I was instead
hung up on. I called back and someone else tried to
transfer me, then came back on the line (I think the person
who wanted to repossess my truck wouldn't talk to me!) In
any case, I spoke to this person, Eric, who told me if I
paid the arrears that day the vehicle would not be
repossessed. I went to Western Union and sent a "Quick
Collect" for the full amount of the arrears immediately.
This was on a Friday afternoon.
The following Monday my truck was repossessed. It cost me
a day and a half, $535, gas, and etc., and when I finally
got the truck back my cds were all scratched and the rear
tail light and door were damaged.
What is my recourse? Since the payment was made as
promised, I contend that Honda Finance had my car stolen.
Now, event though I'm current in payments, every time I
hear a noise at night I go to the window and make sure my
truck is still there. Every morning the first thing I do
Is check the carport. It's made me NUTS!
I live in South Florida. Can anyone help me?
