I live in Massachusetts. I was injured in a motor vehicle
accident. My PIP carrier exercised their rights of
subrogation from the defendant's out of state insurance
carrier. However, my bodily injury claim settled for the
full policy limits and I signed a release evidencing that
fact. The out of state insurance company nevertheless cut
a check for the subrogation amount out of my settlement
money. How can I get my PIP carrier to reimburse me this
money. From what I understood, the PIP carrier had no
subrogation rights since my bodily injury claim settled
for the full policy limits. Any advice and or statutory
references would be appreciated.
