Hello, My name is Larry Chavallo; my wife is being held in Mitchell, SD on an extradition hold. Her warrants are out of Benton Co. Washington and are for some unpaid tickets, and forgery charge she was convicted of for a check that she tried cashing for someone claiming not to have I.D. The check also happened to been taken from a good friend of the lead prosecutor of Benton Co. She was arrested around the first of July for this and is still in there with no word of when she will be extradited and or released. I am at home now with a 1 year old little girl and had a heart attack during this time. My question to you is how long can South dakota hold her before having to release her? Also if you don't mind I would like to ask you one more question, I would greatly appreciate it. Prior to being convicted of this charge my wife was approached by her attourney, and two detectives. They had struck a deal with the prosecutor on this charge to drop it for a written statement on an individule that had committed a crime that my wife had wittnessed. Along with that; knowing that I had worked in bounty in the past they asked that I track this individual for them do to they could not locate him. We agreed; my wife wrote the statement, and I with one address to go from and a discription of the individual mentioned was able to track him in an arrest that included 13 other arrests at a drug house that was located accross the street from a school house; an arrest that made the news the next day. After fullfilling our end of the agreement; the prosecutor refused to fullfill her end of the agreement, and did not drop this charge, and convicted her of it; saying that the was not put on paper. I thinking that their word would be as strong as oak due to this was a deal offered by the prosecutor, two detectives, and my wives attourney was in shock that they would re-nig on the agreement. Is this legal on their part, and how can I take action for this if not?
